User Service Agreement

1 – Parties

1.1: MRHOSTBD INC. providing the services (referred to as the Services) specified in the services section of this contract. 2 – Theme

These service and transaction disclosures are as follows.

3.8: It accepts and undertakes that it is responsible for all files, documents and programs it contains within the customer service, all transactions that it will use and benefit from with its website and e-mail services, and that it will meet all legal and penal liability that may arise from the illegality of such data, information and statements. it does. MRHOSTBD does not review pages for content before they are posted and does not verify, endorse, or otherwise take responsibility for the content of any user-created pages. MRHOSTBD may terminate user accounts for violating these guidelines or for any other reason or because MRHOSTBD believes it is harmful to its or any of its users. MRHOSTBD has the right to delete the acts and actions that violate the law without informing the customer.

3.9: MRHOSTBD cannot be held responsible in any way for the material or moral damages that may arise from the content of the customer data within the service it provides, the incorrect / malicious use of these contents, as well as the e-mail data sent and received. 3.11: Responsibility of MRHOSTBD in return for its services; equal to the monthly cost of the service received. In case of any disruption, problem or loss that may occur in customer services, the demand for compensation cannot exceed the monthly cost of the service.

3.16: The customer continues his service by accepting that all the resources specified as Unlimited in the services he uses are unlimited if he uses them in good faith and in accordance with the general terms of use. 3.17: MRHOSTBD may decide to terminate the service without putting forward any conditions, regardless of the content and scope of the product and service used. If the customer does not accept the return transaction or does not respond to the relevant notifications, the relevant balance is reflected in the account as plus balance.

3.18: MRHOSTBD reserves the right to stop the expired domain name, hosting, or other services after the expiration date, to cancel the service completely. There is no obligation to keep any data records after the cancellation of expired or unpaid services.

3.19: MRHOSTBD fully complies with the requirements of ICANN and REGISTRAR companies in the domain name registration services. All responsibilities and processes in this regard are valid as the conditions of REGISTRAR companies. The Customer is responsible for the control of the whole process in case of errors that may occur in processes such as registration, update, editing, change, deletion due to malfunctions or access problems that may occur during this work.

3.20: Domain name registration, renewal or editing processes are done through 3rd party software or manual processes. In case of errors that may arise from such transactions, the customer is obliged to share these notifications with MRHOSTBD in case the user realizes the error or is warned by the registrar company. Otherwise, MRHOSTBD is not responsible for any disruption, damage or loss that may occur.

3.21: MRHOSTBD shares the customer information with the Domain Operator or the intermediary firm, as it is mandatory during the registration process in domain name registration. MRHOSTBD or domain operators may suspend the domain due to unverified whois information as per ICANN rules. It may request documents that will request verification of whois information.

3.22: Registration, transfer, renewal, whois, NS update, status change etc. In domain transactions, MRHOSTBD applies the rules and agreements related to the registry operator (registrar) from which it receives service, as well as the relevant ICANN rules. These rules may change over time. The user is deemed to have accepted all possible changes that can be made in this agreement and rules.

3.23: In domain name dispute resolution, MRHOSTBD takes action according to the rules of the registrar. UDRP process can be applied in accordance with ICANN rules for dispute resolution in domain names such as .com .net .org. The user accepts that these substances and processes can be applied in the domain names on MRHOSTBD.

3.24: For domain name dispute resolution, MRHOSTBD may direct the user to legal authorities, the Domain Name dispute resolution mechanism (UDRP), as well as limit or close access to the domain name via the panel when it deems necessary. 3.28: Domain name services are not a product sold, but a form of service for which the right to use is received during the period for which the fee is paid. For this reason, if the fee is not paid within the expiration period of the domain name, this right may be transferred to another person.

4 – Duration

4.1: The specified rights and obligations of the parties begin with the transmission of the order and payment transactions of this contract to MRHOSTBD over the internet.

4.2: The contract period is the payment period chosen by the customer during the order for the relevant service.

5 – Fee

5.1: The fee to be paid for the services specified in this contract is the amount specified during the order process. It is calculated by adding VAT to the specified fees later, and the collection is realized by showing it to the customer.

5.2: MRHOSTBD reserves the right to make future changes on prices and tariffs without prior notice. The customer accepts, declares and undertakes the changes that may occur in advance regarding these changes.

5.3: The fee is paid by converting into Turkish Lira at the effective selling rate of Garanti bank on the order date.

5.4: From the date of final order to the end of the 5th business day, if there is a credit card payment order during the ordering process, the customer is obliged to pay by hand to the bank account numbers specified in the contact address or to MRHOSTBD if there is no credit card payment order.

5.5: In case of delay in payment, MRHOSTBD reserves the right to issue a late interest invoice.

5.6: MRHOSTBD reserves the right to close or open the relevant service until the customer completes the payment process.

5.7: The customer is obliged to inform MRHOSTBD about the payments of the services he has received, regardless of the payment method. The notice must clearly state the order number, the name of the product or service paid for, and the method of payment.

6 – Suspension

6.1: MRHOSTBD reserves the right to stop all services provided to the customer, e-mail, web, ftp accounts due to problems in payment, provision problems for customers with credit card payment orders, or clauses and obligations.

6.2: During the continuation of this situation, e-mail, web, ftp access cannot be made on behalf of the customer, and e-mail accounts are blocked and incoming e-mails are rejected.

7 – Termination

7.1: If the customer does not fulfill his responsibilities and commitments by violating any article of this contract, or if it is determined that the information declared on the front of this contract is not correct, in case the suspension of the above-mentioned contract continues for more than 7 days, MRHOSTBD shall not give any warning or notice. has the right to terminate the contract unilaterally without the need for it.

7.2: After such termination, the customer; declares, accepts and undertakes that he will not be able to claim the last contract fee paid, regardless of the remaining time, and to pay commercial penal indemnity 5 times the precedent contract price in force on the date of termination.

7.3: In the event that the contract is terminated by the customer before the expiry date, it declares, accepts and undertakes to pay 1/2 of the fees to be paid until the end of the contract, in full and in advance.

8 – Contact and Information Addresses

8.1: The parties have accepted, declared and committed to the addresses specified in the order address as legal notification addresses for all kinds of notifications arising from the contract.

8.2: Any notification made to these addresses shall be deemed to have been served even if the parties do not receive it. Unless the changes in these addresses are notified to the other party in writing, the old addresses will be valid.

8.3: MRHOSTBD may send messages, information, letters, warnings, payment notifications, account movement schedule, account statements to the e-mail address allocated to the customer within the contract period. The customer declares, accepts and undertakes that he/she will not be able to claim that the electronic messages in question have not been received or have not reached him, and that he will be deemed to have notified it legally.

9 – Default in Payment of Fee

9.1: If the customer does not pay for the services received within 7 days following the application date, it is deemed to be in default. In this case, MRHOSTBD may issue a foreign exchange difference invoice or request 7% monthly delay interest from the invoice date if it wishes. The customer declares and agrees to pay this delay interest and foreign exchange difference invoice.

9.2: In case of MRHOSTBD’s lawsuit or enforcement proceeding for any receivables arising from this contract, the customer may also pay 7% monthly delay interest, 50% penal clause of the remaining debt amount, 10% Attorney’s Fee and all other legal expenses. declares, accepts and undertakes to pay.

9.3: If the Customer applies to the legal authorities for Precautionary Seizure and Precautionary Measures for the collection of his receivables arising from this contract, MRHOSTBD is authorized to take an unsecured Precautionary Attachment and Precautionary Injunction; declares, accepts and undertakes that the fee will be paid by them and that they will not object to these issues.

10 – Authorized Courts and Enforcement Offices

10.1: This contract, however, consists of 10 articles and sub-headings, and has been read, understood and signed by the parties. (Signature is deemed to have been realized by sending the order to MRHOSTBD on the internet). MRHOSTBD may add, remove or modify new articles and/or sub-titles if deemed necessary. 10.2: US Courts and Enforcement Offices are authorized to resolve any disputes that may arise during the implementation of this contract.
